TERMS AND CONDITIONS
These Terms and Conditions apply to all transactions between us and yourself. They do not affect your statutory rights. Please read them carefully.
We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on our website which may include images or updates to products.
These Terms and Conditions are governed by English law and are subject to the non-exclusive jurisdiction of the English courts. We do not accept amendments to these Terms and Conditions.
Failure by us to enforce any of these Terms and Conditions will not affect our right to enforce the rest of these terms and conditions at a later date.
These Terms and Conditions do not affect your statutory consumer rights.
We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.
To order goods over the telephone or on our website, you must be at least 16 years of age and accept delivery within the UK or Europe. All telephone orders will be acknowledged verbally at the time of order and placed online to view at a later date. All orders placed on our website will be acknowledged electronically by e-mail, giving you access via our online customer portal which can be found here https://www.fightnfit.co.uk/my-account/. Please note that verbal and/or electronic acknowledgements do not constitute order confirmation or order acceptance. Your order will be accepted and the creation of a legally binding contract between you and us will take place once the goods have been paid for and dispatched or collected. (Alternatively, we may decline all or part of your order for any reason, in which case we will inform you in-person, by telephone or by e-mail).
When deciding whether or not to accept your order we may use certain information about you, including any received from credit reference agency checks. This helps to protect you and us against fraudulent transactions.
All transactions are subject to validation checks from our payment gateway’s which can be found here https://stripe.com/dpa/legal and https://www.paypal.com/de/webapps/mpp/ua/privacypps-full?locale.x=en_DE, when deemed necessary or if any part of the validation checks have failed we may ask for further information relating to the cardholder in order to verify the payment and thus process the order.
The total price payable will be stipulated at the time when you place your order whether or not the order has been acknowledged. We are entitled to make adjustments to the price to take account of any increase in our suppliers’ prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been acknowledged. We will inform you of the correct price and give you the opportunity to cancel the order. All prices are inclusive of VAT but exclusive of delivery charges which will be payable as indicated at the time the order is placed.
From time to time the prices displayed on our website may be different if you are directed to it from a third party website. Purchases at these prices can only be made on our website and by arriving on it through a relevant third party website; these prices will not be available in-store or over the telephone.
Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If a product becomes unavailable we may offer you an alternative product.
On occasion, the prices payable and promotions offered in respect of goods advertised on the website may differ from those prices and promotions offered at the same time in-store. We are under no obligation to honour any in-store price or promotion in the event that they differ from those on the website. Similarly, our store is under no obligation to honour any website price or promotion in the event that they differ from that in-store.
Although we endeavor to ensure that all pricing information on the website is accurate, occasionally an error may occur and goods may be mispriced. If we discover a pricing error we will, at our discretion, either: contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.
Prices that are reduced for sales and promotions are only valid for the specified period.
Your order is sent directly to our secure back office system for processing. Once we have received your order and payment our staff or that of our suppliers will pick, pack and dispatch the item. Our aim is to dispatch all UK mainland orders between 1-4 working days (Mon-Fri, not inc. Bank Holidays) from your order confirmation. International orders are normally 3-7 working days (Mon-Fri, not inc. Bank Holidays). We will endeavour to contact you within 48hrs from the next business working day from the placement of your order, if there are any issues relating to it. There may at times be a technical delay at the time of placing your order to when it is processed through our system resulting in a change in our stock holding. If an item becomes out of stock in this way we will advise, usually via email as soon as we possibly can. On completion of your order you will receive an email notification which will include tracking details for your parcel, please note that your parcel will require a signature on receipt. However, If after 7-10 working days (Mon-Fri) from order shipment confirmation you have not received your order and one of our sales team has not been in contact with you, please call us on 0117 336 1073 or email mailto:firstname.lastname@example.org quoting your order number given either via email or on your online account and surname with billing and delivery address, we will update you on your order status.
Please note that any orders placed after 13.00hrs will automatically start processing from the following day of business.
You can track the progress of your order at any time by logging into My Account from the Home page on our web site. If your order has been dispatched you will then be able to track your parcel via the couriers web site that we have chosen to send your order with and use the consignment number that we will have provided you upon dispatch.
We use the industry leading internet payment companies STRIPE to protect your card details and protect us from fraud. The following security systems are used.
All transaction information passed between merchant sites and the STRIPE Systems is encrypted using 256-bit SSL certificates. No cardholder information is ever passed unencrypted and any messages sent to your servers from STRIPE are signed using MD5 hashing to prevent tampering. You can be completely secure in the knowledge that nothing you pass to the STRIPE servers can be examined, used or modified by any third parties attempting to gain access to sensitive information.
ENCRYPTION AND DATA STORAGE
All sensitive data is secured on STRIPE using the same internationally recognised 256-bit encryption standards used by, among others, the UK Government. The encryption keys are held on state-of-the-art, tamper proof systems in the same family as those used to secure VeriSign’s Global Root certificate, making them all but impossible to extract. The data we hold is extremely secure and we are regularly audited by the banks and banking authorities to ensure it remains so. All card data is not stored by us and we cannot access that data.
LINKS TO BANKS
STRIPE has multiple private links into the banking network that are completely separate from the Internet and which do not cross any publicly accessible networks. Any cardholder information sent to the banks and any authorisation message coming back is secure and cannot be tampered with.
No individuals within our company or STRIPE are able to decrypt transaction information or cardholder data. Our systems only allow access to our most senior staff and only in extenuating circumstances (such as investigations of Card Fraud by the Police). Your transaction information and customer card information is secure even form our own employees because our systems never display the full card numbers, even on administration screens.
We use the industry leading internet payment company PayPal to protect your card details and protect from fraud. PayPal keep your information safe. We will never actually see your bank or credit card details; they are passed in a highly secure way directly to PayPal for processing. Industry-leading fraud prevention is just one of the reasons PayPal is a safe way to pay online. PayPal uses proprietary technology and constantly innovates to monitor transactions and maintain a secure payment system. Delivery is charged as priced on each order. Our aim is to dispatch all UK mainland orders between 1-4 working days (Mon-Fri, not inc. Bank Holidays) from your order confirmation, unless the Next Day Delivery option is selected. Next Day delivery orders are only available for dispatch on Mondays to Fridays and to UK mainland addresses. International orders are normally 3-5 working days (Mon-Fri, not inc. Bank Holidays). If you wish to cancel your order after it has been dispatched, you will be charged for both delivery and collection cost. Most deliveries will be sent using our courier DPD Local and will have a tracking number issued at time of dispatch.
If you are unavailable when our delivery partner tries to deliver your order, they will usually try to deliver again the next working day or they will drop a card in to offer you a collection from a local collection point. If you should refuse delivery of goods, or are not available to accept the delivery on both delivery attempts, you will be required to cover any extra costs incurred.
All quoted delivery prices are for most UK Mainland addresses. Ireland, Northern Ireland (BT), Isle of Man (IM), Scottish Highlands and Orkney Isles (PA, ML, EH, KA, G, KY, PH, DD, AB, IV, KW), Outer Hebrides and the Shetland Isles (HS, ZE) will incur additional charges and may also experience delivery delays; morning, Saturday and “next working day” deliveries are optional and will also incur additional charges.
We will only deliver goods to the address provided on your order. If another delivery address is provided after an order is received, we will make further checks to verify this address and once verified we will dispatch your order accordingly. An extra delivery may be required if our quoted delivery post coded areas are breached. We will contact you to discuss in more detail if this is the case.
Please note that some countries may charge import tax or duties on parcel’s arriving into their respective customs department. We are not liable for these charges nor are we able to assist with what these charges may be as each country sets their own rules and rates.
PROMOTIONAL FREE DELIVERY PERIODS
Free delivery is available on website purchases being shipped to UK mainland addresses with a total weight that does not exceed 40kgs. Free delivery will only be applicable whilst the promotion period lasts as stated on our home page or social media during the promotion. Products exempt from free delivery are all those that are listed as ‘out of stock’ or any items over 40kgs.
NEXT DAY PRIORITY DISPATCH SERVICE
If you would prefer your order to be delivered faster than our standard delivery time, please select the next day delivery option at the shopping basket. All UK mainland orders will then be dispatched on the same day, on a next working day (if ordered after 1pm), unless directly stated within the product description. Please note, orders must be placed before 1.00pm (Monday-Friday only) to be dispatched the same day. Orders placed on a Saturday, Sunday, Bank Holiday Monday after 1.00pm will not be dispatched until the next available working day (Monday-Friday) If an item should go out of stock we will endeavour to inform you on the day of your order or by the next working day.
All information provided on the products on this website is intended as a guide only. Dimensions and weights are only approximate, as are colours. If you are ordering goods that are out of stock we will dispatch them when they are received from our supplier.
On occasion goods are subject to availability and delay in delivery of goods is sometimes outside our control. As such, delivery cannot be guaranteed and any dates we specify for the delivery of the goods are approximate only. We shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods.
Any unwanted items must be sent back at the customer’s expense in original packaging and condition. If you wish us to give you a quote for this please send us an e-mail, otherwise return the goods to:

If you are unhappy with the goods received we will refund or exchange them if they are sent back at the customer’s expense in new resalable condition within 30 days along with the original proof of purchase.
We suggest for your own protection you use Royal Mail Recorded post.
Any refunds will be issued once we have received the goods, in their original condition. This refund only includes the total of goods sent not the delivery charge. Please note that any items that have been customised, personalised, used for filming, production or photo shoots are non-returnable.
We will not charge a restocking fee for returned items and any exchange items will be sent with no delivery charge for UK Mainland customers. Non UK and overseas customers can request a re-delivery quote before, or upon returning their exchangeable goods.
Any goods with manufacturing faults on arrival will be replaced or refunded.
This does not affect your statutory rights.

These Terms and Conditions of Sale shall be governed by the laws of England and you agree to submit to the non-exclusive jurisdiction of the English courts. We are required by law to inform you that sales can be concluded in English only and that no public filing requirements apply.
All correspondence must be in English. Our usual opening hours are Monday to Saturday 10.00am to 4.00pm. Closed Bank Holidays, and between Christmas and New Year.
